Terms and Conditions for Participation in Social Media Giveaways
The English version of the terms and conditions is provided for informational purposes only; the German version is legally binding.
The following terms and conditions apply exclusively to participation in free giveaways on the social media channels of the organizer, Kulturprojekte Berlin GmbH.
1. Procedure of the Giveaway
The duration of each giveaway on the social media channels of the Long Night of Museums Berlin listed below is specified individually. Within this period, users have the opportunity to participate online.
For the current giveaway, the period is from June 15, 2026 (from the time the giveaway post is published) until June 22, 2026, 23:59 (closing time).
As part of the giveaway, 3 × 2 tickets for the Long Night of Museums on August 29, 2026 in Berlin will be raffled.
2. Participation in Giveaways
To participate in giveaways on the social media channels of the Long Night of Museums Berlin, participants must post the correct answer in the comments under the giveaway post by the date/time specified above. In addition, participants must follow the organizer’s Instagram account. Participation is free of charge and is not dependent on the purchase of goods or services.
The giveaways on the social media channels of Kulturprojekte Berlin GmbH are not supported, sponsored, or organized by Instagram or Meta. There is no cooperation between Kulturprojekte Berlin GmbH and Instagram or Meta.
The prize will be raffled among all valid entries. Entries received after the closing time will not be considered. Only one entry per participant will be accepted. The use of multiple accounts to increase chances of winning is prohibited.
3. Eligibility
Eligible to participate are natural persons who reside in Germany and are at least 18 years old. If a participant has limited legal capacity, the consent of their legal representative is required.
Not eligible to participate are all persons involved in the conception and implementation of the giveaway and employees of the Long Night of Museums Berlin/Kulturprojekte Berlin GmbH.
Kulturprojekte Berlin GmbH reserves the right to exclude individuals from participation if there is a valid reason, for example:
(a) in case of manipulation related to access to or execution of the giveaway
(b) in case of violation of these terms and conditions
(c) in case of unfair conduct
(d) in case of false or misleading information in connection with participation
4. Notification and Delivery of the Prize
Winners will be determined after the closing time through a random draw among all participants. Winners of giveaways on the social media channels of the Long Night of Museums will be notified via direct message on Instagram. No links or payment requests will be sent by Kulturprojekte. Winners will be contacted exclusively via the official the Long Night of Museums account.
The prize will be handed over exclusively to the winner or their legal representative. Exchange or cash payment of the prize is not possible.
Any costs incurred for national shipping of the prizes will be covered by Kulturprojekte Berlin GmbH. Any additional costs related to claiming the prize are the responsibility of the winner.
If a winner does not respond within 48 hours after a single notification, the prize may be transferred to another participant.
5. Data Protection
Providing personal data is necessary to participate in the giveaway. The legal basis is Art. 6 para. 1 lit. b GDPR (execution of the giveaway).
The controller responsible for data processing in connection with the giveaway is Kulturprojekte Berlin GmbH (contact details see legal notice/imprint).
Only data that is absolutely necessary for the implementation of the giveaway will be collected. The participant confirms that the personal information provided, in particular first and last name, is truthful and correct.
The participant agrees that their personal data will be transferred to Kulturprojekte Berlin GmbH for the organization of the giveaway. No personal data will be shared with third parties beyond this.
An exception is Kulturprojekte Berlin GmbH/Long Night of Museums Berlin, which is responsible for the implementation of the giveaway and must collect, store, and use the data for this purpose. Data will be processed until it is no longer required for the purpose. Personal data will be deleted as soon as it is no longer needed for the giveaway, but no later than three months after completion.
Participants have the right to access, rectification, deletion, etc. of their data. The participant may withdraw their consent at any time. The withdrawal must be submitted in writing to the contact details provided in the website’s legal notice. Upon withdrawal, all collected and stored personal data will be deleted immediately.
6. Termination of the Giveaway
Kulturprojekte Berlin GmbH expressly reserves the right to terminate the giveaway without prior notice for valid reasons, particularly if the proper execution of the giveaway cannot be guaranteed.
7. Liability
Kulturprojekte Berlin GmbH is only liable for damages caused intentionally or through gross negligence by itself, its legal representatives, or agents.
In the case of slightly negligent breaches of essential contractual obligations (cardinal obligations), liability is limited to foreseeable, typical contractual damages.
Liability for damages resulting from injury to life, body, or health remains unaffected.
Furthermore, Kulturprojekte Berlin GmbH is not liable for technical disruptions, particularly failures of networks, electronics, or the social media platforms used, which may affect participation in the giveaway. The same applies to delayed or incomplete submissions.
The organizer assumes no liability for the loss or limitation of prize claims due to incorrect information provided by participants.
8. Applicable Law
Questions or complaints regarding the giveaway should be directed to Kulturprojekte Berlin GmbH. Contact details can be found in the website’s legal notice. The giveaway is subject exclusively to the laws of the Federal Republic of Germany.
Legal recourse with regard to the determination of winners is excluded.
9. Severability Clause
Should any provision of these terms and conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions. In place of the invalid provision, the legally permissible regulation that most closely reflects the economic purpose of the invalid provision shall apply. The same applies in the event of a gap in these terms and conditions.
